The NYSE and many other US exchanges use much broader definitions of \"professional\" user status when it comes to accessing your real-time market data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For these exchanges, the definition of \"professional\" and \"non-professional\" is more closely linked to the person using the data than to the type of use itself. People who are employed by a financial institution, for example, are classified as \"professional\" - even if their work is not related to trading or the financial markets - because their employer is a bank, for example. Similarly, individuals who are registered with a financial regulatory authority (e.g. FINRA) are classified as \"professionals\", even if this registration is related to activities that are not stock market or financial related.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Fees charged by data providers to professional users tend to be significantly higher than fees charged to non-professional users.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please note that the classification is done by the exchanges. CapTrader has no influence on the status definitions set by the exchanges, but as an intermediary between the data providers and the end users, CapTrader is obliged to ensure that the set definitions are applied.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Criteria for classification as a \"Professional\" user<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The following list includes many of the criteria that data providers and exchanges use to determine whether a real-time market data user should be classified as \"Professional\" or \"Non-Professional\". A user is classified as \"Professional\" if any of the following statements apply to the user\/account. These definition criteria have been compiled taking into account a number of exchanges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Links to specific information documents can be found at the bottom of the page.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the account is not held in the name of a natural person<\/li>\n\n\n\n<li>If the account is an organization account<\/li>\n\n\n\n<li>If the user is registered with a securities agency<\/li>\n\n\n\n<li>If the user is registered with a self-regulatory authority<\/li>\n\n\n\n<li>If the user is involved in a financial services business or is employed as a financial advisor<\/li>\n\n\n\n<li>If the User is registered in any capacity with the SEC, the Commodities Futures Trading Commission, any federal securities agency, any securities exchange or association, or any market or association for commodity or futures contracts<\/li>\n\n\n\n<li>If the user is acting as an \"investment adviser\" as defined in Section 202(a)(11) of the Investment Advisors Act of 1940 (whether or not registered\/qualified under that Act)<\/li>\n\n\n\n<li>If the user is employed by a bank or a company that is not required to register under national or state securities laws to perform activities that would require registration or qualification if performed for an entity that is not exempt from the registration requirement<\/li>\n\n\n\n<li>If the user operates as a bank or financial services provider<\/li>\n\n\n\n<li>If the user uses data for commercial purposes<\/li>\n\n\n\n<li>If the user is registered\/qualified as a professional securities trader or investment advisor with a national or state securities exchange, regulatory agency, professional body or recognized professional association<\/li>\n\n\n\n<li>If the User is acting on behalf of an institution engaged in brokerage, banking, investment, or financial services<\/li>\n\n\n\n<li>When the user collects fees from customers<\/li>\n\n\n\n<li>If the user is professionally active in the securities sector<\/li>\n\n\n\n<li>If the user is a broker\/dealer, or it is a broker\/dealer account<\/li>\n\n\n\n<li>If the user is an investment advisor<\/li>\n\n\n\n<li>If the user is a registered agent who conducts trading or provides trading advice<\/li>\n\n\n\n<li>If the user or account is an investment club, whether or not compensation is received<\/li>\n\n\n\n<li>If the user is a subcontractor or independent contractor<\/li>\n\n\n\n<li>If the user uses the data in any form for the benefit of third parties<\/li>\n\n\n\n<li>If the user subscribes to, receives or uses data for private use purposes on behalf of another person or a corporation, partnership, limited liability company or trust, association or other form of entity<\/li>\n\n\n\n<li>If the user subscribes to, receives, or uses data for private use purposes in a service that is paid for by another person or by a corporation, partnership, limited liability company, or trust, association, or other form of entity<\/li>\n\n\n\n<li>If the user obtains\/uses data within the scope of an employment relationship or a trade or business activity<\/li>\n\n\n\n<li>If the account is a trust with more than one trustee<\/li>\n\n\n\n<li>If the account is a trust and the trustee is not a natural person. If the trustee is an organization and the sole owner of the organization is a natural person, this does not change the circumstances.
