Questionnaire on "NON-PROFESSIONAL" status for market data subscriptions

The NYSE and most other U.S. exchanges require vendors to actively verify and confirm the market data subscriber status of each customer before allowing the purchase of market data. Going forward, the Non-Professional Questionnaire will be used to determine and actively confirm the market data subscriber status of all subscription customers. In accordance with exchange regulations, if the customer has not been explicitly identified as a non-professional, the status "Professional" will be used as the default subscriber status for the purchase of market data. This process protects and manages the correct subscriber status of all new market data subscribers. A brief guide to the definition of Professional/Non-Professional status designations can be found on the following page: Definition for Professional Users according to NYSE and other US ExchangesThe "Non-Professional" status designation can only be awarded if all questions in this questionnaire have been answered. Since the exchanges require active confirmation as proof of non-professional classification, an incomplete or ambiguous non-professional questionnaire is not sufficient and will result in classification as a professional subscriber until the actual status is proven with sufficient clarity.

Explanations to the questions of the questionnaire

1. commercial and industrial purposes
a) Do you obtain financial information (including news or quote data on securities, futures, commodities and other financial instruments) for your company or another commercial entity?

Explanation: Do you obtain and use the market data - beyond the use of the data for this account for your personal purposes - on behalf of a company or other organization?

b) Do you trade securities, futures/commodities, or foreign exchange for the benefit of a corporation, partnership, professional trust, professional investment club, or other entity?

Explanation: Are you acting only for yourself or on behalf of a corporation (Ltd, LLC, GmbH, Co., LLP, Corp., or similar)?

c) Are you party to a contract that provides for (a) a sharing of the profits from your trading activities or (b) the receipt of remuneration for your trading activities?

Explanation: Do you receive compensation for your trading activities or do you share the profit from your trading activities with a third party entity or person?

d) Are you provided with a place of work and equipment or other benefits in return for your trading activities or your work as a financial adviser to a person or commercial entity?

Explanation: Receive any form of consideration from a third party for your trading activities (this consideration does not have to be a monetary payment).

a) Are you currently acting in an investment adviser or broker-dealer capacity?

Explanation: Are you compensated (consideration) for managing the assets of a third party or do you receive compensation (consideration) for advising third parties regarding the management of their assets?

b) Do you act as an asset manager for securities, futures/commodities or foreign exchange?

Explanation: Do you receive compensation (consideration) for managing securities, futures/commodities, or foreign exchange?

c) Do you currently use the financial information obtained in a business capacity or to manage your employer's or company's assets?

Explanation: Do you use market data in any way for commercial purposes, especially to manage the assets of your employer and/or your company?

d) Do you use the capital of another person or entity in the execution of your trading transactions?

Explanation: Are there assets in your account that do not belong to you but to another person or entity?

3. dissemination, republication or provision of the data to third parties.

a) Does your activity in any way involve the dissemination, redistribution, publication, provision or otherwise making available of financial data of the Data Service to third parties?

Explanation: Do you disclose any data you receive from us to third parties in any way?
